The Federal Law No. (28) of the year 2005 regarding Personal Status, as amended by Federal Law No. (5) of the year 2020, stipulates that its provisions apply to the citizens of the United Arab Emirates and the residents therein. If the claim is related to a request for the annulment or invalidity of marriage contracts, divorce, or separation, and the claim is filed by a citizen wife or a wife who has lost the nationality of the country, provided that either of them has a domicile or residence in the country, or the claim is filed by a wife who has a domicile or residence in the country against her husband who has a domicile, residence, or workplace in the country, especially if the husband has abandoned his wife, established his domicile, residence, or workplace abroad, or has been deported from the country.
If the claim is related to a request for financial support for parents, the wife, or a minor, and they have a domicile, residence, or workplace in the country.
If the claim is about the legitimacy of a minor who has a domicile, residence, or workplace in the country, or it involves a guardianship or financial matter, and the minor or the person subject to guardianship has a domicile, residence, or workplace in the country, or there is another domicile, residence, or workplace for the absent party.
If the claim is related to a matter of personal status, and the plaintiff is a citizen or a foreigner with a domicile, residence, or workplace in the country, provided that the defendant does not have a known domicile or residence abroad, or if the national law is applicable in the country.
If there are multiple defendants, and one of them has a domicile, residence, or workplace in the country.
The law defines marriage as a contract that signifies the enjoyment of one spouse over the other legally, with the aim of providing protection and establishing a stable family under the care of the husband, based on foundations that ensure they bear their burdens with affection and mercy. The approval of the guardian is a requirement for the validity of marriage under UAE law, but in case of the guardian’s refusal to consent to the marriage, the authority shifts to the judge.
Articles 143/144 of the law specify the necessary conditions for the custodian: mental competence, reaching the age of maturity, trustworthiness, ability to raise, maintain, and care for the ward, immunity from serious infectious diseases, no prior conviction for a crime against honor, and adherence to the same religion as the ward.
The surrogate mother must be free of a foreign husband. If the custodian is the father, he must have a suitable female for custody.
